If you do not protect your trade mark by registration, your right to use the name in business is always open to attack and to dilution (even if you have the URL and company name) and you will be at risk of losing the right to use the name and any associated URL altogether.

If you use a name that is already registered by someone else, you may be liable in damages to them for trade mark infringement and have to stop using the name. If this happens you will lose the goodwill and reputation you have built up in the name and will have to adopt another name. The commercial and legal cost of inadvertently using a name that is owned by another business can be considerable.
